Dear owners of the lands through which the gas pipes pass,
The expropriation procedure is carried out as follows:
- Based on the final project approved in 2016, JSC NER prepares the expropriation reports in accordance with the Law on Expropriation,
- According to the expropriation reports, the Bureau for expertise makes estimates of the value of the plots subject to expropriation.
- According to the estimates, the Office for property and legal affairs schedules hearings with the owners and conducts the expropriation procedure.
- All owners who agree with the estimated value, sign an expropriation agreement.
- After signing the agreement, JSC NER makes the payment to the owners.
- In cases when the owners do not agree with the expropriation value, the procedure is continued in the competent basic courts.
-The courts are the only body that can change the value of expropriation.
-NEVERTHELESS, ACCORDING TO THE LAW ON EXPROPRIATION, THE COURT PROCEDURE DOES NOT DELAY THE EXPROPRIATION (THE PROCEDURE IS CONDUCTED ONLY FOR THE VALUE OF THE OWNERSHIP)
-If the court decides on a larger amount, JSC NER makes the payment on the basis of the court decision.
-PAYMENT IS MADE ONLY TO THE LEGAL OWNERS (REGISTERED IN THE PROPERTY LIST)
-IF THE OWNERS (DE FACTO), DID NOT RESOLVE THE SUCCESSION PROCEDURE, THE PAYMENT CANNOT BE CARRIED OUT AND IN THAT CASE A TEMPORARY AGENT WILL BE APPOINTED.
-There are two types of expropriations for each plot:
-Complete expropriation, with a width of 7 meters
- Incomplete expropriation with a width of 18 meters.
-In all plots the gas pipes are installed in depth and after the completion of the project, the owners can use the plots for planting annual crops (without deep roots),
- The whole line along which the route passes is marked with visible signs,
- All plots are returned to their original condition,
- At a distance of 5 m to the left and right of the axis of the gas pipe, planting of trees with deep roots is not allowed,
- At a distance of 30 m to the left and right of the axis of the gas pipeline, a construction of a facility is not allowed, due to security reasons.
